Terms of Service for Telepath

1. Acceptance of Terms

By accessing or using the Telepath platform provided by Bad Command AI d/b/a Telepath ("Telepath"), you agree to be bound by these Terms of Service.

2. Description of Service

Telepath is an infrastructure bridging service that connects SIP telecommunications traffic to third-party AI interfaces. We provide the plumbing (signaling and media handling) but do not generate the content.

3. Third-Party Services (Disclaimer)

Telepath acts solely as the technical bridge between your telecommunications carrier and your AI provider.

• No Control: We do not govern, control, or assume liability for third-party data policies, uptime, or content generation.
• AI Hallucinations: AI agents may generate incorrect, offensive, or hallucinated content. Telepath is not liable for actions based on AI outputs.
• Independent Relationships: Your agreements with carriers and AI providers are separate from these Terms.

4. Customer Responsibilities

• Compliance: Ensure use complies with applicable laws, including TCPA and robocall/robotext rules.
• Content: You are the sender of communications; Telepath relies on applicable carrier safe-harbor frameworks.
• Credentials: Secure your API keys and SIP credentials.

5. Payment and Capacity

• Capacity Tier: Service is billed by concurrent channel capacity or provided under free-tier limits.
• Overage/Throttle: If usage exceeds purchased capacity, Telepath may reject (SIP 503) or throttle additional calls.

6. No Emergency Services (911)

• No 911 Access: Telepath is not a replacement for traditional telephone services and cannot connect to emergency services (911/112/999).
• Health and Safety: Do not use AI agents for life-critical workflows without human-in-the-loop redundancy.

7. Prohibited Use & High Risk Activities

• Unsolicited marketing in violation of TCPA/DNC rules.
• Operation of nuclear facilities, air traffic control, or life support systems.
• Impersonation or fraud.

8. Indemnification

You agree to indemnify and hold harmless Bad Command AI (Telepath) from claims, damages, or legal fees arising from AI-generated content, telemarketing law violations, or third-party claims regarding your bot behavior.

9. Limitation of Liability

To the maximum extent permitted by law, Bad Command AI is not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits/revenues. Aggregate liability is limited to amounts paid in the prior 12 months or $100, whichever is greater.

10. Termination

We may suspend or terminate access for illegal use, overdue payment, or attempts to reverse engineer the Telepath engine.

11. Governing Law

These Terms are governed by the laws of the State of New Jersey, United States, without regard to conflict-of-law provisions.
